Well, this is a pretty dry cut issue. Open source is open source. The programmer failed to understand the meaning of the term, and he decided to be difficult. He hurt himself, and the community should not have to pay for that. Imagine if Google had the power to take down Android (or the parts of it that are completely open source) because they Sergey woke up upset one day… That would be silly and contradictory to the meaning of open source.
